A BILL
To prohibit the availability of Federal education funds for

indirect support from the Government of the People’s
Republic of China.

SECTION 1. SHORT TITLE. 1
This Act may be cited as the ‘‘Promoting Responsible 2
Oversight To Eliminate Communist Teachings for Our 3
Kids Act’’ or the ‘‘PROTECT Our Kids Act’’. 4
SEC. 2. PROHIBITION ON AVAILABILITY OF FUNDS. 5
(a) P
ROHIBITION
.—Notwithstanding any other provi-6
sion of law, no funds may be made available under an ap-7
plicable program to any elementary school or secondary 8
school that— 9
(1) has a partnership in effect with a cultural 10
or language institute directly or indirectly funded by 11
the Government of the People’s Republic of China, 12
including a Confucius Institute; 13
(2) operates a learning center directly or indi-14
rectly supported by the Government of the People’s 15
Republic of China (commonly referred to as a ‘‘Con-16
fucius Classroom’’); or 17
(3) otherwise receives support from an indi-18
vidual or entity acting directly or indirectly on behalf 19
of the Government of the People’s Republic of 20
China, including support in the form of teaching ma-21
terials, personnel, funds, or other resources. 22

.—The prohibition under sub-23
section (a) shall take effect on the date that is one year 24
after the date of enactment of this Act. 25

.—Not later than 1
90 days after the date of enactment of this Act, the Sec-2
retary of Education shall provide notice to elementary and 3
secondary schools of the requirements of this Act together 4
with guidance for achieving compliance with such require-5
ments. 6

EFINITIONS
.—In this Act: 7
(1) A
PPLICABLE PROGRAM
.—The term ‘‘appli-8
cable program’’ has the meaning given that term in 9
section 400(c)(1) of the General Education Provi-10
sions Act (20 U.S.C. 1221(c)(1)). 11
(2) ESEA
TERMS
.—The terms ‘‘elementary 12
school’’ and ‘‘secondary school’’ have the meanings 13
given those terms in section 8101 of the Elementary 14
and Secondary Education Act of 1965 (20 U.S.C. 15
7801). 16
